Think Business Terms of Service

1. This is an agreement between you and Think Business

You hereby represent that you are at least 18 years of age and that you have attained the age of majority country in which you reside, and that any information that you submit in Think Business is correct.

2. How ThinkBusiness may modify this agreement

Think Business reserves the right to change the terms, conditions, and notices under which it offers the Think Business, including any charges associated with the use of the Think Business Websites and services. You are responsible for regularly reviewing these terms, conditions and notices, and any additional terms posted on Think Business Websites. Your continued use of the Think Business Websitess after the effective date of such changes constitutes your acceptance of and agreement to such changes. Think Business Websitess may itself contain additional terms that further govern use of the Think Business Websitess, including without limitation, particular features or offers.

3. No commercial, unlawful or harmful use of the Think Business Websites

You will not use the Think Business Websites in any way that is unlawful, or harms Think Business, its affiliates, resellers, distributors, service providers and/or suppliers. You may not use the Think Business Websites in any manner that could damage, disable, overburden, or impair the Think Business (or the network(s) connected to Think Business) or interfere with any other party’s use and enjoyment of the Think Business Websites.

4. Materials you post or provide: communications monitoring

For materials you post or otherwise provide to Think Business Websites related to the Think Business Websites you grant Think Business permission to Use, copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, modify, translate and reformat your Submission, each in connection with the Think Business Websites

5. Liability limitation; your exclusive remedy

In no event will any Think Business party be liable for any damages, including without limitation any indirect, consequential, special, incidental, or punitive damages arising out of, based on, or resulting from this agreement or your use of the Think Business Websites, even if such Think Business party has been advised of the possibility of such damages The exclusion of damages under this section is independent of your exclusive remedy and survives in the event such remedy fails of its essential purpose or is otherwise deemed unenforceable. These limitations and exclusions apply without regard to whether the damages arise from:

Breach of contract
Breach of warranty
Negligence
Any other cause of action, to the extent such exclusion and limitations are not prohibited by applicable law
If you are dissatisfied with our terms/services, or do not agree with any part of this agreement, or you have any other dispute or claim with or against any Think Business with respect to this agreement or the Think Business services, then your sole and exclusive remedy is to discontinue using the Think Business services.

6. Changes to the Think Business Website

The Think Business parties may change the Think Business Websites or delete features in any way, at any time and for any reason. As you use the Think Business Websites , you should expect to receive, access or use information, materials, graphics, software, data and content (collectively, “content”) originated by Think Business and persons other than Think Business (any such person is referred to as a “third party”). You acknowledge and agree that the Think Business parties are not responsible or liable for:

Any content, including without limitation, any infringing, inaccurate, obscene, indecent, threatening, offensive, defamatory, tortuous, or illegal content,
Any third party conduct, transmissions or data. In addition you acknowledge and agree that Think Business is not responsible or liable for (1) Any viruses or other disabling features that affect your access to or use of the Think Business Websites (2) Any incompatibility between the Think Business Websites and other Websites, services, software and hardware,
Any delays or failures you may experience in initiating, conducting or completing any transmissions or transactions in connection with the Think Business Websites in an accurate or timely manner,
Any damages or costs of any type arising out of or in any way connected with your use of any services available from third parties though links contained on the Think Business Websites.
The limitations, exclusions and disclaimers in this agreement apply to the maximum extent permitted by applicable law, and are not intended to deprive you of any mandatory protections provided to you under applicable law.

7. Termination

Think Business may terminate this Agreement, or terminate or suspend your access to the Think Business Websites at any time, with or without cause, with or without notice. Upon such termination or suspension, your right to use the Think Business Websites will immediately cease.

8. You have limited time to bring your claim back

You and Think Business agree that any cause of action arising out of or related to the Think Business Websites must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

9. Other Terms

i. Customer Support

It has been the goal of Think Business since its founding to provide top-quality customer support and satisfaction. This section clarifies our role in providing a web hosting service. There are various features such as ASP, ODBCs, PHP, etc. that we provide to our users. Due to the complex nature of supporting such services, we are unable to support users in learning how to take advantage of them. Our support team will ensure that the settings are correct on our servers, but we may be unable to assist users in setting up their own files and applications. At the discretion of Think Business, we are able to provide some advanced support services. Depending on the scale and complexity of the work, a support fee may apply, with details provided on application.

ii. Payment using Credit / Debit Card / Paypal

If you are in Kenya, we advise you to make payment in cash, cheque or MPESA paybill. Credit card / Debit card or Paypal is high due to currency fluctuations and Merchant transaction Fees. It is your responsibility to check on the amount charged at checkout point

iii. Payment and receipts

When the system sends a receipt, it only acknowledges receipt of payment, and not delivery of the service. If service is not delivered, we shall issue a refund.
